These Terms of Service ("Terms") govern your use of the Bargain Barks website and online booking system, and your use of our pet grooming services. By accessing our website or booking a service, you agree to these Terms. If you do not agree, please do not use our website or services.

1. Services

Bargain Barks Pet Grooming provides professional dog grooming services, including but not limited to bathing, brushing, haircuts, nail trimming, ear cleaning, teeth brushing, de-shedding, and specialty treatments. We groom dogs of all breeds and sizes. We do not currently groom cats or other animals.

2. Appointments and Booking

• Appointments are confirmed once accepted by Bargain Barks. Online booking is a request, not a guarantee, until confirmed.
• We welcome walk-ins based on availability but recommend booking in advance, especially on weekends.
• Estimated completion times are approximate and depend on your pet's size, breed, coat condition, and temperament.
• We reserve the right to refuse or reschedule an appointment for any reason, including safety concerns for your pet or our staff.

3. Pricing and Payment

• Pricing is flat-rate and starts at the listed amounts. Final pricing may vary based on your pet's size, coat condition, matting, behavior, or special requests.
• We will inform you of any price adjustments before proceeding whenever possible.
• Payment is due at the time of service pickup. We accept cash and major cards.
• Promotions and discounts (including the FIRSTBARK new-client discount) may not be combined and may be modified or discontinued at any time.

4. Cancellation and No-Show Policy

• If you need to cancel or reschedule, please notify us at least 24 hours in advance.
• Repeated no-shows or late cancellations may result in a requirement to prepay or pre-book future appointments.
• Pets must be picked up within a reasonable time after grooming is complete. Extended late pickups may incur a boarding or care fee.

5. Your Pet and Health Disclosure

• You are responsible for accurately disclosing your pet's health conditions, allergies, medications, temperament, and any aggressive or fearful behavior before grooming begins.
• Failure to disclose behavioral or medical issues may result in injury to your pet or our staff and may affect your ability to book future services.
• Pets should be up to date on vaccinations. Please inform us of your pet's vaccination status if asked.
• If your pet is found to have fleas, ticks, or contagious conditions, we may administer treatment at your expense or reschedule the appointment.

6. Grooming Outcomes and Limitations

• Grooming results depend on your pet's coat condition, behavior, and length of time between grooms. Severely matted coats may require shaving for the safety and comfort of your pet.
• We will always act in the best interest of your pet's welfare. If we determine a requested style is not safely achievable, we will use our professional judgment.
• We are not liable for pre-existing conditions discovered during grooming, including skin irritations, matting damage, or clipper irritation on sensitive skin that was not disclosed.

7. Cage-Free Environment

Bargain Barks is a cage-free salon. Dogs may interact with other dogs in an open pen before and after grooming. You are responsible for informing us if your pet is not social with other dogs. We reserve the right to separate or decline service to pets that display aggression toward other animals or staff.

8. Assumption of Risk and Release

Pet grooming involves inherent risks. By using our services, you acknowledge and accept that your pet may experience stress, minor scratches, clipper irritation, or other unforeseen reactions. You release Bargain Barks, its owner, and staff from liability for any injury, loss, or damage to your pet or property, except to the extent caused by our gross negligence or willful misconduct.

9. Website Use

• You agree to use our website lawfully and not to misuse, disrupt, or attempt to gain unauthorized access to our systems.
• All content on this website, including text, graphics, logos, and images, is the property of Bargain Barks or its licensors and may not be reproduced without permission.
• Reviews and testimonials reflect individual experiences and are not guarantees of specific results.

10. Limitation of Liability

To the fullest extent permitted by law, Bargain Barks shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of our website or services. Our total liability for any claim related to grooming services is limited to the amount you paid for the specific service at issue.

11. Indemnification

You agree to indemnify and hold harmless Bargain Barks, its owner, and staff from any claims, damages, or expenses arising from your pet's behavior, your failure to disclose information, or your breach of these Terms.

12. Governing Law

These Terms are governed by the laws of the State of Arizona, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Maricopa County, Arizona.

13. Changes to These Terms

We may update these Terms at any time. Continued use of our website or services after changes constitutes acceptance of the updated Terms.

14. AI-Assisted Features and Automated Tools

Our website uses certain automated and AI-assisted features to make booking easier. By using these features, you agree to the terms in this section. A more detailed explanation of how these tools handle your data is in our Privacy Policy, including the AI Disclosure section.

14.1 Nature of AI Features

• Breed autosuggest, booking quiz, and "When to Book" guidance: These features provide general, automated suggestions based on your input. They are conveniences and educational tools, not professional veterinary, medical, or grooming advice, and they do not account for your pet's individual health, skin, temperament, or medical history.
• Live availability counters: Slot counts are automated estimates from our scheduling system. They are not a guarantee that a specific time is available. Your appointment is confirmed only when accepted by Bargain Barks.
• Automated reminders and references: SMS/email reminders, referral codes, and booking reference numbers are generated automatically. You are responsible for keeping your contact information current so reminders reach you.
• Form validation: Real-time checks help catch typos but are not a substitute for providing accurate information. You are responsible for the accuracy of all details you submit.

14.2 No Automated Decisions About Your Pet

We do not use AI or automated tools to decide whether your pet is suitable for grooming, to diagnose health or behavioral conditions, or to determine pricing. All such decisions are made by our trained human staff. Automated features assist with convenience and scheduling only. If you believe an automated suggestion is incorrect or unsafe for your pet, disregard it and contact us.

14.3 Accuracy and Limitations of AI Tools

• Automated suggestions, availability counts, and grooming-frequency guidance may be incomplete, outdated, or incorrect. We do not warrant that AI-assisted features are error-free or will meet your specific needs.
• You should always rely on your own judgment and your veterinarian's advice for matters affecting your pet's health, not on automated website guidance.
• We may modify, suspend, or discontinue any AI-assisted feature at any time without notice.

14.4 Third-Party AI and Embedded Content

Our site links to or embeds third-party services (such as Google Maps and Instagram) that may use their own automated processing. We do not control and are not responsible for the AI, data, or accessibility practices of those third parties. Your use of third-party services is subject to their separate terms and policies.

14.5 Limitation of Liability for AI Features

To the fullest extent permitted by law, Bargain Barks is not liable for any damages or losses arising from your reliance on automated or AI-assisted features, including breed suggestions, availability estimates, grooming-frequency guidance, or form validation. These tools are provided "as is" for convenience. Our liability for grooming services remains as stated in Section 10 of these Terms.

15. Website Accessibility

We are committed to providing a website that is accessible to all users, including those with disabilities, and we strive to meet WCAG 2.1 Level AA guidelines.
